Today, a company called Bonzi Software settled a class action law suit which alleged deceptive Internet adverstising. The suit, filed in Washington state in November, accused Bonzi of engaging in a “diabolical scheme” that tricked Internet users into clicking through to Bonzi’s site by displaying online ads that mimicked dialog boxes with “message alert,” security alert,” or “warning” in the creative. This lawsuit raised some interesting issues relative to what can be done in advertising on the Internet. Indeed, there is are a growing number of lawsuits, investigations, and enforcement actions being initiated by the Federal Trade Commission, and private plaintiffs directed at Internet businesses, and that’s where the opportunity exists.
